Reservation of rights relating to AI & digital technologies
Musique Nomade (“we”, ‘us’ or “our”) is committed to protecting the rights of creators, performers and all others involved in the production of music and other creative content. This statement constitutes a formal reservation of our rights concerning the use of our content in connection with artificial intelligence (AI) and related technologies.
1. Prohibition of unauthorized use
We expressly prohibit any access, use, copying, reproduction, extraction, modification or exploitation of our works or content (hereinafter “Our Content”), including but not limited to sound recordings, audiovisual works, musical compositions, lyrics, metadata, works of art, the name, image, likeness and/or voice of our artists. This prohibition applies, without limitation, to the following activities, regardless of intent or purpose:
● The training, development or commercialization of AI systems ;
● Data harvesting, web scraping, text or data extraction, or any other similar activity, including robots, data collectors and extractors; or
● The creation of databases, derivatives or extracts, or any similar activity.
These activities are prohibited unless explicitly and specifically authorized in advance in the form of a written license.
2. Scope of rights reserved
We reserve all rights to Our Content in accordance with the applicable laws and all other applicable Canadian federal and provincial laws and regulations, as well as all applicable international laws and treaties, including, but not limited to:
● Rights relating to text and data mining, reproduction, adaptation, public performance and communication to the public, including making the work available to the public ;
● The protections provided by international treaties such as the Berne Convention and all other applicable bilateral or multilateral agreements.
We expressly reserve all rights with respect to copyright exceptions or limitations and any other legal rights related to the use of our content for AI purposes under Canadian law and any applicable laws or international treaties.
No rights are implied or granted by the public accessibility of Our Content; any use must be expressly authorized by a written license. We expressly object to any use of Our Content for text and data mining purposes, except as expressly authorized by written license.
3. Worldwide application
This reservation of rights applies worldwide, ensuring that Our Content is protected in all jurisdictions where it may be used or exploited, including under exceptions or limitations introduced for AI-related purposes.
4. Public accessibility does not mean authorization
Even if Our Content is accessible by public means (e.g. streaming platforms or online repositories), this does not constitute authorization to use it for AI-related purposes. Any such use requires explicit authorization in the form of a written license.
5. Protective measures and enforcement
Any unauthorized use of Our Content is prejudicial to our legitimate interests and conflicts with their normal exploitation. We reserve the right to take all necessary measures, including legal action, to protect Our Content and enforce our rights.
